Privacy Policy

Effective date: January 18, 2025

This Privacy Policy describes how we collect, use, disclose, and safeguard personal data when you use the FluidLoss Companion mobile application (the "App"). It also explains your privacy rights under the UK GDPR, EU GDPR, and comparable laws (including California's CCPA/CPRA).

1. Data We Collect

We collect and process the following categories of data:

  • Identifiers such as a device identifier (on iOS, identifierForVendor; on Android, ANDROID_ID or a generated UUID).
  • Health and fitness data such as heart rate, distance, pace, speed, calories, workout duration and elapsed time, obtained from your Garmin device via Garmin Connect Mobile.
  • Activity data such as imported activities you choose to upload (e.g., GPX or TCX files).
  • Usage and diagnostics data such as technical logs, crash data, app version, and platform version.
  • App functionality and personalization data such as your model preferences (personalized vs. generic, multiplier setting).

We do not sell your data or share it for cross-context behavioural advertising.

2. Sources of Data

  • Directly from your Garmin device via Garmin Connect Mobile.
  • From you, including preferences and optional imports.
  • From our Cloud API, which provides prediction results.

3. How We Use Data

We use your data to:

  • Stream watch metrics and provide real-time fluid loss predictions.
  • Display information on your Garmin device.
  • Improve predictions with imported activities or model preferences (if you choose).
  • Maintain pairing and avoid repeated setup.
  • Debug, detect errors, and improve service reliability.
  • Ensure security and prevent misuse.

We do not make decisions with legal or similarly significant effects solely by automated processing.

4. Legal Bases

  • Explicit consent: When you first launch the App, you must tick a checkbox to consent to processing your health and fitness data. Without this consent, the App cannot function as intended.
  • Contract necessity: For delivering the App's features once you have consented.
  • Legitimate interests: For security, fraud prevention, debugging, and de-identified analytics.

You may withdraw consent at any time in App Settings. Withdrawal does not affect prior lawful processing but may limit functionality.

5. Sharing and Disclosures

  • Our cloud prediction service receives only the minimum data necessary to return predictions.
  • Platform providers (Apple and Google) may receive crash or diagnostic data, depending on your device settings.
  • Garmin Connect Mobile facilitates Bluetooth connections and is governed by Garmin's own privacy policy.
  • We may disclose data when required by law, court order, or to protect rights and safety.

6. International Transfers

If we transfer data outside the UK or EEA, we apply safeguards such as Standard Contractual Clauses or the UK International Data Transfer Addendum, along with technical and organisational protections.

7. Data Retention

  • Device identifiers are retained locally until you uninstall or reset the App.
  • Real-time metrics are used ephemerally and not stored unless part of your activity database.
  • Imported activities remain until you delete them in the App or withdraw consent.
  • Cloud predictions are retained until delivered and for up to 30 days for service improvement, then de-identified or deleted.
  • Logs are retained temporarily for support and then deleted or anonymised.

8. Your Rights

Under UK/EU GDPR

  • Access your data.
  • Correct inaccuracies.
  • Request deletion.
  • Restrict processing.
  • Receive a portable copy of your data.
  • Object to processing based on legitimate interests.
  • Withdraw consent at any time.
  • Complain to the Information Commissioner's Office in the UK or your local authority.

Under California CCPA/CPRA

  • Access, correct, and delete your data.
  • Opt-out of sale or sharing (not applicable here).
  • Limit use of sensitive personal information (we only use health data for the features you request).

9. Security

  • Data in transit is protected with TLS encryption.
  • On iOS, identifiers are stored securely in the Keychain.
  • On Android, identifiers are stored with EncryptedSharedPreferences.
  • Backend systems apply least-privilege access controls.

10. Children's Privacy

The App is not intended for children under 16 in the UK/EU or under 13 in the US. We do not knowingly collect data from such children. If you believe a child has provided data, contact us for deletion.

11. Third-Party Links and SDKs

  • Garmin Connect Mobile facilitates Bluetooth connections and is governed by Garmin's privacy policy.
  • Apple (App Store, TestFlight) and Google Play may receive crash reports and distribution data, subject to their own policies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be notified in the App or in the App Store listing. Continued use after changes indicates acceptance.
